Understanding Utah Workers' Comp Rates
Utah is an NCCI state with a competitive market and some of the lowest workers' compensation costs in the country. NCCI files advisory loss costs with the Utah Insurance Department, which reviews them before each insurer applies its own loss-cost multiplier (LCM). Utah's annual loss-cost filing carries an anticipated effective date of February 1 — not the January 1 date used by most NCCI states — so Utah renewals priced early in the calendar year may still reflect the prior year's filing. The Labor Commission of Utah, through its Division of Industrial Accidents, administers the system itself: it handles coverage compliance, dispute adjudication, and the medical fee schedule under the Utah Workers' Compensation Act (Utah Code Title 34A).
Utah also has a competitive state fund, WCF Insurance (originally the Workers Compensation Fund of Utah), which writes alongside private carriers rather than using the exclusive state-fund model documented in Ohio workers' compensation rates. Because Utah is an advisory-loss-cost state, the NCCI number is only a starting point — each carrier, including WCF, files its own LCM, so two Utah insurers can quote the same class code at materially different prices. Your actual premium is the class-code loss cost × LCM × experience modification factor × payroll/100, plus or minus schedule rating credits or debits.
How Utah Class Codes and Rates Are Set
Utah uses the standard NCCI Scopes Manual classification system — the same national four-digit codes that apply in most states (8810 Clerical Office Employees, 8742 Outside Sales, 9082 Restaurant NOC, 5183 Plumbing NOC, 5403 Carpentry NOC, and roughly 600 others). The scope language is national; the loss-cost dollar attached to each code is Utah-specific and reflects Utah claim experience. NCCI files the advisory loss costs each year for a February 1 effective date, and the Utah Insurance Department reviews the filing before insurers can apply their multipliers.
Price competition in Utah happens at the loss-cost multiplier, not the advisory loss cost. Your premium is the class-code loss cost × LCM × experience modification × payroll/100, plus or minus schedule rating. Because Utah sits among the lowest-cost states nationally, even construction codes run lower here than in many other jurisdictions — but comparing carriers' LCMs, including WCF's, is still what moves a Utah small-business premium, not the headline statewide loss-cost change.
Who Must Carry Coverage in Utah
Utah requires workers' compensation coverage for essentially every employer with one or more employees under the Utah Workers' Compensation Act. The statute carves out a narrow set of exceptions — some agricultural laborers, casual workers, domestic workers below an earnings threshold, and licensed real estate and insurance agents working on commission — but the default rule for private employers is the one-employee threshold.
Sole proprietors and business partners are not automatically covered on themselves and may file to elect inclusion if they want their own benefits. Corporate officers and LLC members are generally treated as employees and counted toward coverage, though Utah allows certain owners and officers to exclude themselves by filing a coverage waiver with the Labor Commission's Division of Industrial Accidents. Out-of-state employers performing work in Utah typically need their coverage extended to Utah, because exclusive-remedy protection depends on valid Utah coverage being in force. The Labor Commission enforces the mandate and can assess penalties and stop-work measures against uninsured employers.
