Understanding Florida Workers' Comp Rates
Florida is an NCCI state — the National Council on Compensation Insurance files annual rate recommendations with the Florida Office of Insurance Regulation (OIR), and the OIR reviews and approves the filing before insurers can write business at the new rates. The Florida Division of Workers' Compensation, inside the Department of Financial Services, is a separate agency: it administers the Reemployment Assistance and exemption registry, enforces coverage compliance, and handles claim disputes. NCCI sets the class codes and the loss costs; OIR approves them; the DWC enforces who must carry coverage.
On January 1, 2026, an NCCI-filed average voluntary-market rate decrease of 6.9% took effect in Florida — approved by Insurance Commissioner Mike Yaworsky on November 17, 2025 and the ninth consecutive year of decreases, driven by improving statewide loss experience, lower indemnity claim frequency, and continued downward pressure on construction medical costs. The 6.9% is an average across all class codes; individual class codes shifted by more or less than that. It also is not what you actually pay — Florida insurers can deviate from filed loss costs through their own Loss Cost Multiplier (LCM), and your renewal premium also reflects your experience modification factor and any schedule rating credits or debits.
How Florida Workers' Comp Class Codes and Rates Work
Florida uses the standard NCCI Scopes Manual classification system — the same four-digit class codes (8810 Clerical Office Employees, NCCI code 8742, 9082 Restaurant NOC, class code 7610 radio and television broadcasting, 5645 Carpentry-Detached One- or Two-Family Dwellings, workers comp code 5213, 5403 Carpentry NOC, 8017 workers comp code, workers comp code 8010, etc.) that apply in most states. The numbers and scope language are national, but the loss cost dollar attached to each code is Florida-specific and reflects Florida claim experience. NCCI publishes an annual rate filing for Florida that the OIR must approve before it takes effect; the most recent approved filing reduced the statewide average by 6.9%, effective January 1, 2026. Two construction-specific rules separate Florida from typical NCCI states. First, Florida applies a credit program — premium credits that reward construction employers with above-state-average payroll per worker — administered through NCCI's Florida construction class code rates. Second, Florida is one of only a handful of states where the construction industry has a standalone exemption framework: a corporate officer or LLC member doing construction work can apply for a state-issued exemption (limited to three exemptions per construction business), but exempt status forfeits coverage if the officer is injured on the job.
Coverage Thresholds and the Florida Construction Carve-Out
Florida's coverage mandate is split. Non-construction employers must carry workers' comp once they reach four or more part-time or full-time employees (counting corporate officers and LLC members unless they file a non-construction exemption). Construction employers — including any business that has at least one construction operation — must carry coverage from the first employee, with no minimum-employee threshold. Agricultural employers have their own threshold (5 regular employees or 12 seasonal employees working more than 30 days).
Independent contractors are not automatically excluded from these thresholds. Florida's Construction Industry Workers' Compensation Coverage Act (Section 440.10(1)(b), Florida Statutes) treats most construction subcontractors as the contracting employer's workers for coverage purposes when the sub does not carry its own policy — meaning the general contractor's policy is rated on the subcontractor's payroll. This is one of the most common Florida audit surprises: a GC who assumed a sub's COI was sufficient but later finds the sub had let the policy lapse mid-job.
