Understanding Kentucky Workers' Comp Rates

Kentucky is an NCCI state with a competitive insurance market and rates near the national average. On October 16, 2024, the Kentucky Department of Insurance announced that NCCI's annual voluntary-market loss-cost filing lowered average loss costs 8.4%, effective January 1, 2025 — the 19th consecutive year Kentucky workers' compensation loss costs have declined. NCCI is the licensed rating and statistical organization for Kentucky: it collects Kentucky payroll, premium, and injury data and files advisory loss costs with the Kentucky Department of Insurance for the voluntary market. Each insurer then applies its own loss-cost multiplier (LCM), so the NCCI loss cost is a starting point, not a fixed price. The Kentucky Department of Workers' Claims, part of the Education and Labor Cabinet, administers the system itself — it oversees coverage compliance and resolves contested claims through an administrative process rather than the regular courts, under KRS Chapter 342.

Because Kentucky is an advisory-loss-cost state, price competition happens at the multiplier. Your premium is the class-code loss cost × LCM × experience modification factor × payroll/100, plus or minus schedule rating credits or debits. Two Kentucky carriers can quote the same class code at different prices because their LCMs differ, so comparing the multiplier — not just the headline statewide loss-cost change — is what moves a Kentucky small-business premium.

How to find a Kentucky workers' comp class code from a job description

There is no Kentucky workers' comp class code for a job title. NCCI files the classifications used in Kentucky, and the NCCI rules are what an auditor applies, and what gets classified is the employer's business — not the separate employments, occupations or operations inside it. "Machinist", "CNC operator", "general construction labor" and "data entry" are therefore work that sits inside whichever classification describes the business, not values you can look up on their own.

NCCI publishes Kentucky's classifications in the uniform classification system filed with the commissioner under KRS 304.13-167(1) (no edition year and no Kentucky-titled book — Kentucky designates the SYSTEM rather than the manual. KRS 304.13-167(1) makes every workers' compensation insurer adhere to a uniform classification system and uniform experience rating system filed with the commissioner by an advisory organization the commissioner designates, and subsection (2) puts the statistical reporting on that same organization's plans; neither the statute nor any regulation in 806 KAR Chapter 13 names the organization or a manual title. The designation is an order instead — the Department of Insurance's own workers' compensation Review Requirements Checklist records it as an Order dated 6-10-2000 under KRS 304.13-061 and KRS 304.13-167, and states that NCCI has been designated as the uniform classification system and experience rating system and that every insurer must utilize NCCI's classification system. The one manual a Kentucky regulation names by title is the neighbouring one: 806 KAR 13:130 Section 3 incorporates NCCI's Experience Rating Plan Manual for Workers Compensation and Employers Liability Insurance by reference and gives the Department of Insurance at 500 Mero Street, Frankfort as the counter where it may be inspected, copied or obtained. KRS 304.13-161(1) requires every insurer and every advisory organization to provide, inside Kentucky, a reasonable means by which a person aggrieved by the application of its rating system may be heard on written request to review the manner in which that system was applied; a granted request has to be reviewed within ninety days, and if the request is refused or simply not granted within thirty days the employer may proceed exactly as if the review had produced no change. KRS 304.13-161(2) then gives any affected party thirty days from written notice of the action to appeal to the commissioner, who holds a hearing under KRS Chapter 13B on a showing of good cause and may issue a final order affirming, modifying or reversing what the insurer or advisory organization did. Subsection (3) adds the part that makes Kentucky unusual: for workers' compensation coverage every insurer or agent has had to notify each insured of those rights in writing at the time the policy is issued or renewed since May 1, 1997, and 806 KAR 13:140 prescribes the wording — a Notice of Insured's Rights that spells out the thirty-day, ninety-day and thirty-day clocks and prints the address the appeal goes to, the Legal Division, Department of Insurance, P.O. Box 517, Frankfort, KY 40602.

Kentucky is the state where the classification decides whether the regulator ever sees the rate change. Kentucky is use-and-file — KRS 304.13-051(1) lets an insurer put commercial rates into effect and file them up to fifteen days after first use — but subsection (5) carves out a per-class exception: no insurer may place into effect rates, manuals or underwriting rules that would move its then-existing rates more than twenty-five percent, up or down, for any classification of risks in any of its rating territories within a twelve month period, and an insurer that proposes to must file everything and wait for the commissioner's approval. The unit of that test is the classification, not the book of business, so a reclassification argument in Kentucky is also an argument about which filing regime the carrier is in. Subsection (7) then gives a thirty day waiting period extendable by another thirty on written notice, puts the burden of showing the filing meets the subtitle on the insurer, and deems the filing approved if it is not disapproved in time — and subsection (8), which applies to workers' compensation and to nothing else, lets the commissioner approve a rate other than the one the filer proposed if the hearing evidence justifies it. Three more things a multi-state employer will not expect. The code on a Kentucky policy need not be one of the filed ones: KRS 304.13-167(3) lets a workers' compensation insurer develop subclassifications of the uniform classification system upon which rates may be made, and subsection (5) has the commissioner disapprove them only where the insurer fails to show that the data they produce can still be reported consistently with the uniform classification and experience rating systems. KRS 304.13-057(1) makes every insurer demonstrate to the commissioner the extent to which its rates are based on its own Kentucky experience, so a countrywide relativity is not a complete answer here. And there is no Kentucky counterpart to the per-class loss cost file Alabama or Colorado publish: the Department of Insurance's own workers' compensation page is three sentences that route every workers' compensation question to the Department of Workers' Claims, and the department's annual announcement gives the statewide average — 6.4 percent across the 586 industrial classes used in Kentucky, for the filing effective January 1, 2024 — rather than the per-code numbers behind it.
