Understanding Colorado Workers' Comp Rates
Colorado is an NCCI state with a distinctive market structure. The National Council on Compensation Insurance files advisory loss costs each year with the Colorado Division of Insurance (DOI) inside the Department of Regulatory Agencies (DORA); the Insurance Commissioner reviews the filing — supported by an independent actuarial review (most recently by The Davies Group) and a public hearing — and issues an order approving the loss costs before insurers can use them. A separate agency, the Division of Workers' Compensation (DWC) within the Colorado Department of Labor and Employment (CDLE), administers the benefit system itself: it adjudicates claims, maintains the medical fee schedule, and enforces the coverage mandate.
Effective January 1, 2026, the Commissioner approved an NCCI-filed loss-cost decrease of 6.9% — the 12th consecutive annual reduction in Colorado, driven by a continued decline in workplace injury frequency. The DOI has reported a cumulative average loss-cost decrease of roughly 56.8% since 2015. What makes Colorado unusual is the presence of Pinnacol Assurance, a state-chartered (but politically independent and competitively priced) insurer that historically writes a large share of the state's policies alongside private carriers — Colorado is competitive, not monopolistic. The 6.9% is a statewide average; individual class codes moved more or less, and your actual premium also reflects your insurer's loss-cost multiplier (LCM), experience modification factor, and schedule credits or debits. The rates table on this page reflects Colorado-approved loss costs in effect under the January 1, 2026 order.
How Colorado Class Codes and Rates Are Set
Colorado uses the standard NCCI Scopes Manual classification system — the same four-digit codes used in most other states (8810 Clerical Office Employees, 8742 Outside Sales, 9082 Restaurant NOC, 5183 Plumbing NOC, 5551 Roofing, 5645 detached dwelling carpentry, workers comp code 5213, 8010 Hardware Store — Wholesale or Retail, and roughly 600 others). The code numbers and scope language are national; the loss-cost dollar attached to each code is Colorado-specific and reflects Colorado claim experience. NCCI submits the recommended Colorado loss costs each year, an independent actuary reviews them, and the Insurance Commissioner issues an order before the new loss costs take effect on January 1.
Carriers deviate from the advisory loss costs by filing their own loss-cost multiplier (LCM) with the DOI. Your renewal premium is the class-code loss cost × LCM × experience modification × payroll/100, plus or minus schedule rating. Two Colorado insurers can quote the same class code at very different prices because their LCMs differ, so comparing the LCM — and, given Pinnacol's market presence, getting at least one private-carrier quote alongside it — is what changes your actual cost rather than the headline statewide change. For the market-structure contrast, Ohio workers' compensation rates come from an exclusive state fund with no private-carrier shopping.
Who Must Carry Coverage in Colorado
Colorado has one of the strictest coverage mandates in the country: under the Workers' Compensation Act of Colorado, virtually every employer with one or more employees — full-time or part-time — must carry workers' compensation insurance. There is no small-business head-count carve-out. The Division of Workers' Compensation enforces the requirement and can impose escalating per-day fines for uninsured periods and issue a cease-and-desist order halting business operations until coverage is obtained.
Sole proprietors, partners, and members of an LLC are not automatically covered on themselves and are not required to carry coverage on their own work, though they may elect inclusion. Working corporate officers and LLC members who are owners may reject coverage for themselves by filing the appropriate election, but their employees must still be covered. Independent contractors who are genuinely free from control and customarily engaged in an independent trade are not counted as employees, but Colorado applies the statutory control test strictly — misclassifying a worker as a contractor to avoid coverage is a common source of penalties.
