Understanding Alabama Workers' Comp Rates

Alabama is an NCCI state. NCCI files voluntary-market loss costs and assigned-risk rates with the Alabama Department of Insurance, which reviews and approves them — the Department took the most recent filing up at a public hearing on December 4, 2025 in Montgomery. Alabama's loss-cost year starts March 1, not the January 1 date used by most NCCI states, and the filing year now in force began March 1, 2026: NCCI's filing for that date carried a 4.5% reduction to voluntary-market loss costs and a 3.6% reduction to assigned-risk rates, following a 6.1% decrease the year before. Claims and disputes are administered separately by the Workers' Compensation Division of the Alabama Department of Labor, under the Alabama Workers' Compensation Act (Ala. Code Title 25, Chapter 5).

Because Alabama is a competitive advisory-loss-cost state, NCCI's filed number is a starting point. Each carrier files its own loss-cost multiplier (LCM) with the Department of Insurance, so two Alabama insurers can quote the same class code at different prices. Your premium is the class-code loss cost × LCM × experience modification factor × payroll/100, plus or minus schedule rating credits or debits. The 4.5% statewide change is an average across all class codes; your own code may have moved more or less.

How to find an Alabama workers' comp class code from a job description

There is no Alabama workers' comp class code for a job title. NCCI files the classifications used in Alabama, and the NCCI rules are what an auditor applies, and what gets classified is the employer's business — not the separate employments, occupations or operations inside it. "Machinist", "CNC operator", "general construction labor" and "data entry" are therefore work that sits inside whichever classification describes the business, not values you can look up on their own.

NCCI publishes Alabama's classifications in the Basic Manual for Workers Compensation and Employers Liability Insurance for Alabama (the Alabama rating plan on file with the Department of Insurance — Ala. Code § 27-13-60(4) defines a rating plan to include every class, classification, rule, standard and manual containing the rates used, § 27-13-65(1) makes the rating organization adopt the basis classifications that all manual, minimum, class, schedule and experience rates are built on, § 27-13-67 bars an insurer from applying any rate before that plan has been filed with the department and then requires it to charge in strict conformity with the filing, and § 27-13-68 deems the filing approved unless the Commissioner disapproves it within thirty days). To confirm the classification for a specific business, use the Alabama Department of Insurance's own workers' compensation page, which posts the Alabama Advisory Loss Costs and the Alabama Assigned Risk Rates for every class code, one file per year, published by the Alabama Department of Insurance rather than by NCCI — that is the filed authority for Alabama, and a code quoted from another state's manual is not. Alabama routes the argument through the Department twice before it reaches a hearing. Under Ala. Code § 27-13-70 a rating organization, or an insurer that makes its own rates, furnishes an affected person all pertinent information as to that rate only after receiving a written request for it from the department — so in Alabama the employer asks the regulator, and the regulator asks the rating organization. Ala. Code § 27-13-71 then requires that organization or insurer to provide a reasonable means inside Alabama, approved by the department, for anyone affected by a rate to be heard on a written application to reduce it. If the application is refused, the employer has thirty days from written notice to make the same application to the Commissioner; if it is neither granted nor rejected within twenty days, the employer may go to the Commissioner as though it had been rejected. The Commissioner fixes a hearing on at least ten days' notice by registered or certified mail and makes the order the evidence supports.

Alabama publishes two per-class numbers and only one of them is a rate. The Department posts NCCI's Alabama Advisory Loss Costs, headed ADVISORY LOSS COSTS - NOT RATES, which exclude every expense provision except loss adjustment expense and loss-based assessments; and separately the Alabama Assigned Risk Rates, which are finished rates with a minimum premium against each code and apply to assigned-risk policies only — the residual market, not the voluntary one a quote comes from. Both are keyed to the same four-digit codes and both send the reader to the Classification codes section of the Basic Manual for any state specific classification phraseology, which is where the Alabama wording of a class actually lives. Two more things a multi-state employer will not expect. Alabama's cycle turns on March 1 rather than January 1, so a filing approved in December reaches policies two months later. And the shortcut other rate changes get is closed here: Ala. Code § 27-13-72(b) lets an insurer adjust the rates for existing classifications on the date named in the filing when the change does not move the relativities between those classifications, and § 27-13-72(d) then says subsection (b) does not apply to workmen's compensation or employer's liability insurance at all.
