NCCI Class Code 9058 — commonly phrased "Hotel — Restaurant Employees" — is the workers' compensation classification for restaurant, bar, and food-service employees directly managed by a hotel, motel, motor court, tourist court, cabin operation, resort, or similar lodging business. It is not the general hotel operations code. Housekeeping, front desk, guest services, maintenance, and most non-food hotel operations belong in the companion hotel NOC class such as 9052 Hotel NOC — All Other Employees & Drivers, unless a state bureau assigns a more specific local classification.
The practical audit question is who controls the food operation. If the hotel employs and manages the cooks, servers, bartenders, hosts, dishwashers, cashiers, and restaurant managers, those food-service employees are generally the 9058 payroll. If an unrelated restaurant tenant operates on the hotel premises under its own payroll and management, the restaurant is classified under the appropriate restaurant or bar code for that employer rather than being pulled into the hotel's 9058 code. What's Included Under Class Code 9058
9058 covers the lodging employer's own food and beverage payroll: cooks, kitchen help, dishwashers, waitstaff, hosts, cashiers, bartenders, food-service managers, banquet restaurant staff, and similar employees when the food operation is part of the hotel or motel business. New York's Classification Digest describes 9058 as restaurant or bar work located within or adjacent to a hotel or motel, and public state code tables list parallel wording such as Hotel NOC — Restaurant Employees or Hotel — Restaurant Employees.
California is a useful state-specific caution. WCIRB's restaurant classification update separates hotel, motel, and short-term residential-housing food or beverage employees into California Classification 9058, while other restaurant operations use different California codes. That reinforces the same boundary: 9058 is a lodging-food-service class, not a generic all-hotel employee bucket.
When the Work Is NOT Coded 9058
Do not use 9058 for the whole hotel payroll. Non-food hotel employees — housekeeping, room attendants, laundry, front desk, bell staff, general maintenance, security, and drivers — normally belong in 9052 or another state-specific hotel class. A separately insured cleaning contractor working at the hotel should be checked against its own service classification, such as 9014 janitorial services, rather than folded into the hotel's restaurant payroll. Clerical office employees may be separated only when the state bureau's standard-exception rules allow it and the work is physically and operationally separate.
Do not use 9058 for a third-party restaurant merely because it sits inside a hotel. If the restaurant is operated by a separate insured that is not itself a hotel, motel, motor-court, tourist-court, cabin, or similar lodging operator, classify that employer under the applicable restaurant, bar, catering, or fast-food code. This distinction matters for payroll records: hotel-managed food service, hotel all-other operations, and tenant restaurant payroll should be tracked separately before the audit.
9058 vs 9052, 9079, and 9082
Use 9058 for hotel-managed restaurant and beverage employees. Use 9052 for the lodging operation's all-other hotel employees when no more specific state class applies. Use 9079 fast food or 9082 Restaurant NOC for restaurant employers that are not operated as part of the lodging business, subject to each state's own restaurant phraseology. The clean test is employer and operation: hotel payroll running the hotel's dining room points to 9058; an independent restaurant tenant points to a restaurant code.
Some independent-bureau states use different numbers or descriptions. New York lists 9058 as Hotel NOC — Restaurant Employees; California uses Classification 9058 for hotel, motel, or short-term residential-housing food or beverage employees; Delaware, Pennsylvania, New Jersey, Michigan, and other independent systems can map hotel food service differently. Always confirm the local bureau before treating a national NCCI-style code as a final quote rule.
