About Class Code 7380: Scope, Inclusions, and Common Misclassifications
NCCI Class Code 7380 — "Drivers, Chauffeurs, Messengers and Their Helpers NOC — Commercial" — is a Standard Exception classification. It covers employees whose principal duties involve operating or working on a vehicle in connection with a business that is otherwise classified under a different governing code (for example, a retail store's delivery drivers or a manufacturer's in-house courier). Because it is a Standard Exception, 7380 can be assigned alongside the primary business classification and is not bound by the usual one-business-one-class-code rule.
The "NOC" ("Not Otherwise Classified") in the phraseology is important: 7380 is only correct when no more-specific driver code applies. If the business itself is a trucking operation, a taxicab service, a bus line, or a hazmat carrier, the drivers belong in the specific industry code rather than 7380.
Because it involves road exposure, 7380 is the most expensive of NCCI's four Standard Exceptions — not a throwaway cheap code. As a dated benchmark, NYCIRB's filed advisory loss cost for New York 7380 payroll was $7.190 per $100 of payroll effective October 1, 2024; that is a filed loss cost, not a quote, and the premium an employer actually pays depends on the carrier's loss-cost multiplier, the experience modification factor, and the state minimum premium.
What's Included in Class Code 7380
The NCCI Scopes definition applies 7380 to drivers, chauffeurs, messengers, drivers' helpers, garage employees, stable hands, and employees using bicycles in connection with the employer's operations. It also covers school bus drivers employed directly by a school district that operates its own buses, as well as mobile food and ice-cream vendors who drive their own vehicles.
Incidental vehicle-adjacent work counts: loading and unloading the vehicle, pickup-and-delivery of parts or materials between locations, routine garage maintenance, and time spent at the wheel in the course of non-trucking business operations.
Common Misclassifications: When 7380 Is the Wrong Code
If you searched for "workers' comp for truck drivers," 7380 is most likely not your code. NCCI assigns trucking-for-hire operations to separate codes: 7219 (Trucking NOC — All Employees) for most commercial motor carriers, 7228 (Trucking — Long Distance Hauling) where loads travel over 200 miles one way, and 7229 (Trucking — Oil Field Equipment Hauling) or 7231 (Trucking — Mail, Parcel or Package Delivery) for specialized haulers. Hazmat trucking carries higher-rated codes of its own.
Drivers transporting the public belong in codes 7370 (Taxicab Co.) or 7382 (Bus Co. — All Other Employees) rather than 7380. A furniture-moving and storage company is another specific-industry case: its drivers, packers, and warehouse staff are rated together under 8293 (Furniture Moving & Storage — Drivers), not split out to 7380. Likewise, when a basic industry classification's own phraseology already includes drivers — for example 9014 (Janitorial Services), 8380 (Automobile Service or Repair), 9082 (Restaurant), 5183 (Plumbing NOC & Drivers), or 9016 (Amusement Park or Exhibition Operation & Drivers) — those drivers are absorbed by the governing code and cannot be broken out to 7380.
California operates outside the NCCI system. The WCIRB Standard Classification System uses its own class numbering, and although a code numbered 7380 may appear in WCIRB search results, the California scope, inclusions, and dual-wage thresholds can differ from the NCCI definition above. Always verify the California classification on the WCIRB Classification Search before relying on an NCCI-based rate.
How 7380 Is Rated and Audited
Being a Standard Exception means 7380 payroll is pulled out of the governing class and rated on its own — but it does not mean the rate is trivial. Of the four NCCI Standard Exceptions, 7380 is by far the most expensive, because operating a vehicle on public roads carries loss exposure that clerical (8810), telecommuter (8871), and outside-sales (8742) duties do not. Splitting driver payroll out of a high-rated governing class usually lowers total premium; splitting it out of an already-low governing class can raise it. Run the math on your own governing rate before assuming the exception helps.
Rates are filed by each state's rating bureau and move on that state's cycle, so the same 7380 payroll costs very different amounts across state lines. New York is a useful benchmark: after the $7.190 per $100 of payroll loss cost in force on October 1, 2024, NYCIRB filed a 13.2% statewide-average decrease effective October 1, 2025, and the DFS-approved October 1, 2026 filing cuts statewide-average loss costs a further 21.9%. Because those are statewide averages, the change for 7380 specifically can differ, and independent-bureau states such as California publish their own 7380-equivalent rates entirely outside the NCCI and NYCIRB numbers.
For an audit, keep records that prove driver payroll is genuinely separable — job descriptions showing that more than half of each driver's time is spent operating or servicing a vehicle, and payroll detail that isolates driver wages from governing-class duties. Where a worker both drives and performs governing-class work, most states require the full payroll to be assigned to the higher-rated classification unless clean records support a split.
