About Class Code 8829: Scope, Inclusions, and Common Misclassifications
Workers' compensation class code 8829 is the facility-based long-term-care classification commonly phrased "Convalescent or Nursing Home — All Employees." It follows the nursing-home operation rather than one job title: New York's official scope includes physicians, registered and practical nurses, dietitians, aides, cooks, housekeeping, laundry, maintenance, security, and other employees who operate the home. That all-employee structure is what separates 8829 from healthcare codes that divide professional and support payroll.
NYCIRB's filed loss cost for New York class 8829 is $1.836 per $100 of payroll for policies effective on or after October 1, 2026 — down 22.7% from the $2.374 the October 1, 2025 filing carried — while NJCRIB publishes a $4.165 manual rate and $1,200 minimum premium effective January 1, 2026 (the New Jersey value as verified July 24, 2026). Those are different bureau filing values — a New York loss cost versus a New Jersey manual rate — not interchangeable carrier quotes. They are useful because they show why an employer must use the governing state's manual instead of treating 8829 as one national price.
What Class Code 8829 Includes
8829 applies to an employer operating a convalescent or nursing home where residents receive facility-based nursing and personal care. NYCIRB's interpretation includes the clinical workforce — doctors, registered nurses, licensed practical nurses, dietitians, and aides — together with cooks, housekeeping, laundry, maintenance, security, and other employees needed to run the home. Patient feeding, bathing, dressing, room cleaning, laundry, medication administration, meal preparation, and building maintenance are all contemplated within the same facility operation.
The phrase "all employees" matters at audit. A nursing home should not automatically split cooks, housekeepers, maintenance staff, or other support employees into lighter classifications merely because their individual duties are non-clinical. The governing bureau's manual controls any exception. Keep payroll by location and operation so a genuine separately rated business can be shown without dividing one employee's wages simply to reach a lower-looking code.
8829 vs 8835, 8833, and 9040
Location and employer control draw the first boundary. A freestanding nursing or convalescent home is the 8829 exposure; caregivers who travel to patients' private residences belong in a home-health classification such as 8835 home health care or the state's local equivalent. A business that operates both a residential facility and a traveling-care division should maintain separate payroll, schedules, and service records for the two operations.
The hospital boundary is different. NYCIRB directs a nursing or convalescent home operated by a hospital at the same or an adjacent location into the hospital pair: 8833 hospital professional employees for professional staff and 9040 hospital all other employees for support staff. An outpatient physician practice that does not provide inpatient overnight care instead belongs in a class such as 8832 physician and clerical. The clean audit question is therefore facility type, employer of record, and whether the long-term-care operation is freestanding or part of the hospital campus.
Assisted Living and State-Specific 8829 Rules
Do not assume every senior-living operation is 8829. Wisconsin's WCRB lists 8829 for convalescent or nursing homes, homes for the aged, and rest homes, but separately divides retirement-living-center healthcare, food-service, and all-other employees among codes 8824, 8825, and 8826. New Jersey uses 8829 for an assisted-living facility only when it provides on-site intermediate or skilled healthcare; an independent-living operation run alongside it is separately rated under New Jersey's building-operation rule.
Those state differences make the facility's actual care model more important than its marketing label. Document whether licensed nursing or skilled care is provided on site, whether residents live independently, whether home-health staff travel away from the facility, and whether a hospital owns and operates the home at the same campus. California, New York, New Jersey, Pennsylvania, and other independent-bureau jurisdictions can change the phraseology, employee split, or code number, so confirm the current state manual before using any figure on this page as a premium estimate.
Rate and Audit Records for Nursing Homes
The figures on this page — filed figures from the states that publish them and a relative cost index for the rest — are a comparison aid, not an insurance quote. Actual premium starts with the state's approved loss cost or manual rate and then changes with the carrier's loss-cost multiplier or filed pricing, payroll, experience modification, schedule credits or debits, minimum premium, and any audit reclassification. New York's 1.836 loss cost (effective October 1, 2026) and New Jersey's 4.165 manual rate are intentionally labeled by value type because multiplying or comparing them as though they were the same carrier price would be misleading.
A defensible 8829 audit file identifies every facility, its license and care level, the employer operating it, its relationship to any hospital, and whether employees work in a separate home-health or independent-living operation. Keep department payroll, job descriptions, shift rosters, home-visit schedules, and contracts for separately operated services. Those records support the all-employee facility assignment while preserving legitimate state-manual splits.
